Privacy policy

Regulatory framework

Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter GDPR), applicable from 25 May 2018, applies to the processing of personal data wholly or partly by automated means, and to the processing other than by automated means of personal data which form part of, or are intended to form part of, a record of processing activities (RAT).

This Regulation has been incorporated into Spanish law by Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (hereinafter LOPDGDD).

Any personal data that may be collected directly from the data subject will be treated confidentially and included in the corresponding processing activity.

Purpose of data processing

The personal data provided by the data subject (such as first name, surname, national ID number (DNI), postal and email address), as well as any data provided in the future as the relationship develops, will be included in a processing register owned by OCT PLUS SOLUTION, S.L.P. for the following purposes:

  • Engineering services: structural and foundation design and calculation, studies of pathologies and structural damage assessment.
  • Conducting information and service-quality surveys at different times.
  • Proactive management of information security, so that all your data available over the Internet complies with the principles of the GDPR.
  • Ensuring the effectiveness of compliance functions and the handling of information and privacy rights, as detailed in Articles 15 to 22 of the GDPR.
  • Exercising or defending complaints or claims of any kind that may arise from the relationship.

Third-party personal data

If the personal data provided belong to a third party, the data subject guarantees that they have informed that third party of this Privacy Policy and obtained their authorisation to provide their data to OCT PLUS SOLUTION, S.L.P. for the purposes indicated above. The data subject also guarantees that the data provided are accurate and up to date, and is liable for any direct or indirect damage or loss that may arise from failure to comply with this obligation.

Personal data retention periods

The personal data provided will be kept for as long as the commercial or employment relationship is maintained and for a period of 5 years, or for the period required by applicable regulations.

If the data subject withdraws their consent or exercises the rights of cancellation or erasure, their data will be kept blocked and at the disposal of the Administration of Justice for the legally established periods in order to address any liabilities arising from the processing of the personal data.

Legal basis for data processing

The legal basis for processing your data is the performance of the contract for the provision of structural engineering services.

Prospective offers of products and services are based on the consent requested from you, and withdrawing this consent will in no case affect the performance of the subscription contract.

Source of personal data

The personal data we process at OCT PLUS SOLUTION, S.L.P. come from you, as we request them in order to establish the relationship for the provision of our services.

The categories of data processed are:

  • Identification data.
  • Tax data for invoicing and accounting management.
  • Postal or email addresses.

No special categories of personal data are processed.

Disclosures and recipients of personal data

No data will be disclosed to third parties, except where required by law or with the data subject's consent.

Data subjects’ rights

Everyone has the right to obtain confirmation as to whether or not we at OCT PLUS SOLUTION, S.L.P. are processing personal data concerning them.

You may exercise the rights of access, rectification and erasure of your data, data portability, restriction of or objection to processing, and the right not to be subject to automated decisions, as well as the right to obtain clear and transparent information about the processing of your data.

Data subjects have the right to access their personal data and to request the rectification of inaccurate data or, where appropriate, request its erasure when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

In certain circumstances, data subjects may request the restriction of the processing of their data, in which case we will only retain the data for the exercise or defence of claims.

In certain circumstances and on grounds relating to their particular situation, data subjects may object to the processing of their data. OCT PLUS SOLUTION, S.L.P. will stop processing the data, except on compelling legitimate grounds or for the exercise or defence of possible claims.

Likewise, you are guaranteed the portability of your data so that you can transfer it to another service provider.
